Application for Stay of Execution Proceedings
This service allows applicants to temporarily suspend enforcement of a judgment or court order until an appeal or reconsideration request is heard, protecting their rights while legal proceedings are pending.
The service allows applicants to request that the Court temporarily stay execution of the judgment or order issued within the framework of execution proceedings, namely, to postpone actions such as collection of money, attachment of property or other legal measures, until a ruling is rendered in the appeal or additional application.
The purpose is to protect the rights of those requesting the stay and prevent harm while the legal proceedings are still pending.
The application may also be filed in the execution file. For an explanation regarding the manner of filing the application, it is possible to contact the Enforcement and Collection Authority.
Common reasons for stay of execution:
- There is a dispute regarding the judgment or order
- The stay is necessary in order to prevent harm to livelihood or business
- There is a temporary problem preventing compliance with the judgment (for example: illness, loss of income or a complex family situation)
The service is intended for those against whom execution proceedings were opened for enforcement of a judgment or order issued by the Court, or for those representing them, for example: an attorney or guardian.
- Details of the reasons: a clear and detailed explanation specifying why a stay of proceedings in the execution file is required.
- Supporting documents: any document verifying the arguments, for example agreements, account statements or other legal documents.
- Affidavit: a document in which the applicants declare the facts presented in the application. The affidavit must be verified by them according to law. For details: Completion and filing of an affidavit.
- Personal undertaking and guarantee in an application for temporary relief: Power of attorney – if the applicants are represented, a power of attorney on their behalf must be attached.
Filing in person
The application form must be printed in three copies and according to the number of respondents, completed and signed.
- If an appeal was filed, the application is to be filed with the Court hearing the appeal.
- If no appeal was filed, the application is to be filed with the Court that rendered the judgment or judicial order.
- It is possible to file the application at the public reception desk of the Court Secretariat, according to local jurisdiction.
For scheduling an appointment. - District filing – it is possible to file the application at any public reception desk of a Court Secretariat in the relevant district.
- The application is transferred for a judicial ruling. The judge reviews the application and the attached documents, and may:
- Approve the application in full
- Deny the application
- Set conditions for stay of execution, such as deposit of money, financial guarantee or another undertaking, in order to ensure compliance with the Court ruling if the application is denied
- It is possible to check the status of processing the application in the Net HaMishpat system, which must be accessed through the National Identification System or using a smart card.

Filing at the public reception desk of the Court Secretariat
- At the end of filing, a confirmation number (reference) will be received.
- It is possible to check the status of processing of the form through the case in Net HaMishpat:
- It must be accessed using the National Identification System or a smart card.
- On the top bar of the website, the case number should be entered, the 'Search' button clicked, and it will then be possible to review it.
- If the case number was forgotten or is unknown:
- It is possible to click on the 'Locate Cases' tab and select 'My Cases'.
- A date range should be entered, and a list of cases will be received, from which the correct case should be selected.
- After entering the case, folders will appear on the right side. The 'Paper File' folder should be opened, in which all documents in the case, including rulings, will appear.
