Personal Undertaking and Security in an Application for a Temporary Remedy
This service enables the submission of a personal undertaking form in an application for a temporary remedy, in accordance with the regulations or with a judicial ruling.
Before Beginning
A temporary remedy is a measure intended to preserve the existing situation, prevent irreversible damage, or ensure that the court’s final ruling can be enforced.
A temporary remedy may be requested at any stage of the legal proceedings, as long as the case is pending. Examples of temporary remedies include: attachment orders, injunctions, orders prohibiting departure from the country, and others.
Who the Service Is Intended For
Anyone who is a party to a legal case submits an application within it and must prove to the court that there is an urgent need for granting a temporary remedy.
Documents Required to Receive the Service
If you are required to attach additional documents, the original documents must not be attached unless the court has ruled otherwise.
Payment for the Service
The service is provided free of charge.
Methods for Receiving the Service
- The form must be printed and completed with all the required details and submitted in one copy to the court, together with additional copies according to the number of respondents.
- The form may be submitted only at the Court Secretariat of the court in which the case is being conducted.
- In some courts it is possible to schedule an appointment at the Secretariat’s public reception desk through GoVisit
What Happens After Submitting the Application
- After the application is submitted, it is transferred for a judicial ruling.
- It is possible to check the status of processing the application in the Net HaMishpat system, which must be accessed through the national identification system or by means of a smart card.
- The website must be accessed only from a computer; it is not adapted for browsing from a phone.
- At the end of submitting the form, a confirmation number will be received. Using this number, it is possible to track the processing of the form in two ways:
- In the personal area:
- In the 'Tracking My Filings' tab – it is possible to view the most recent filings, their confirmation numbers, and the status of their processing.
- You must check the status of processing the submission.
- This may be done after the end of the business day following the submission of the application.
- On the top bar on the website, in the 'Filings' tab –
- Clicking the tab will open a window in which 'Locate Filings by Reference' must be selected.
- You must enter the confirmation number (reference) in the designated field and click the 'Locate' button at the bottom left of the page. The status of processing the filing will be displayed.
- It is possible to check the status of processing the form after the end of the business day following the submission of the application.
- In addition, on the top bar of the Net HaMishpat website it is possible to type the case number, click the 'Locate' button, and then review the case.
- If the case number has been forgotten or is unknown:
- It is possible to click the 'Case Search' tab and then select 'My Cases'.
- You must enter a date range, and a list of cases will be received, from which the correct case must be selected.
- After entering the case, folders will appear on the right. You must enter 'Paper Case', where all the documents in the case, including rulings, will appear.
Notes
- Upon execution of the judgment in the case, the temporary remedy will expire.
- As long as all the conditions listed in the ruling are not fulfilled, the order will not be issued.
