Request for a Protection Order or for a Protection Order with Technological Monitoring
This service allows you to submit a request for a protection order or a protection order with technological monitoring, in order to prevent domestic violence.
Who can submit the request?
Anyone who feels threatened by a family member and seeks the protection of the court.
What should be attached to the request?
- A copy of the complaint filed with the police, if one has been filed
- Any document supporting the request
- If applying for a protection order with technological monitoring, a consent form for the issuance of a protection order with technological monitoring must be attached
- It is recommended to attach the ID number or passport number of the threatening family member
How to Submit the Request
- You must arrive with a valid ID card or passport (a driver’s license is not accepted).
- You must complete an application for a protection order, including the affidavit and the bond of undertaking, attach the required documents, and submit them during office hours at any Magistrates’ Court or any Family Court in the country (regardless of your place of residence) – by scheduling an appointment.
Submitting a request outside court office hours:
- Until 17:00, you should contact the Courts Administration Information and Service Center.
- From 17:00 onward, you should contact the on-call duty center.
- You have the right to receive protection from the court, for details on how to exercise this right and the types of protection that may be granted.
The service is provided free of charge
Important to know
- When the request is submitted for the purpose of obtaining a protection order against minors, it must be submitted only to the Family Courts (it cannot be submitted to the Magistrates’ Courts).
- It is possible to submit a request to extend a protection order that is still in effect, even if the case is closed.
- If the extension request is submitted after the order has expired, a request for a new protection order must be submitted.
- Whenever masculine language is used, it also refers to the feminine, and vice versa.
Further Processing of the Request
- The request will be forwarded to a judge for an urgent decision on the protection order request in a one-sided hearing (applicant only).
- If necessary, the court will issue a decision regarding a protection order with technological monitoring:
- In cases where the court is convinced that there is a danger and that monitoring compliance with the protection order using technological tools is justified, it may authorize their use.
- These tools are based on monitoring and tracking the location of both the threatened person and the threatener and provide alerts in case of a violation of the order or if the threatener enters a predetermined range.
