Filing a Statement of Claim with the Magistrates’ Court or District Court, Under Ordinary Civil Procedure
This service allows filing a statement of claim to open legal proceedings for the purpose of obtaining relief from the Court and conducting the proceedings in accordance with the Regulations.
- Claims the total amount and value of which are up to NIS 2.5 million are to be filed with the Magistrates’ Court.
- Claims the total amount and value of which are over NIS 2.5 million are to be filed with the District Court.
The statement of claim must be completed.
Please note: The statement of claim is to be prepared in accordance with the provisions of the law and is to include the details of the plaintiff and defendant and the grounds for the claim.
The following documents must be attached to the application:
- Documents supporting the claim, for example: agreements, invoices, correspondence, or other evidence.
- In a bodily injury claim, the following must be attached:
- Waiver of medical confidentiality
- Medical opinion upon which the plaintiffs intend to rely.
- A declaration that the plaintiff is to provide the defendant with medical documents and an affidavit in response to questions in accordance with Regulations 15(a)(3) and 17.
- Power of attorney if the claim is filed by an attorney.
Original documents must not be attached to the statement of claim, but only copies, unless the Court orders otherwise.
- The amount of the fee payable is detailed in the updated fees table of the Courts Administration.
- Payment is to be made upon filing the application.
- The plaintiff may file an application for exemption from payment of the fee due to financial inability.
Number of copies of the claim that must be filed:
- If the plaintiffs are represented by an attorney, one copy must be filed with the Court.
- If the plaintiffs are not represented by an attorney, one copy must be filed with the Court and additional copies according to the number of defendants.
Forwarding the statement of claim to the defendants:
- If the plaintiffs are represented by an attorney, the statement of claim is to be forwarded to the defendants by the attorney.
- If the plaintiffs are not represented by an attorney, the Court Secretariat will forward the claim to the defendants.

- Attorneys may file the claim on the Net HaMishpat website.
- It is possible to read the Net HaMishpat guide on how to use the website.
- Before logging in, it is recommended to scan all the documents:
- The total size of the documents is not to exceed 100 MB per file.
- It is possible to attach files in the following formats: PDF document, MP4 video file, MP3 or MP4 audio file, JPEG or PNG image.
- The website must be accessed from a computer; it is not adapted for browsing from a mobile phone.
Logging into the website:
- The website must be accessed using the National Identification System button or a smart card.
- After logging in, attention must be paid to identification as an attorney – the attorney’s license number is to appear at the top left, and not the personal ID number.
- If the ID number appears, this may be changed by clicking on the small arrow next to the number.
- If the arrow does not appear, and it is not possible to choose the attorney’s license number, apparently you are not registered as attorneys in the Net HaMishpat database, In order to register in the database, an online registration form must be completed on the Net HaMishpat website by clicking the lower link in the center of the page – Addition of a New Attorney on the Net HaMishpat website.
Filing the claim:
- The “Open Case” button must be clicked.
- The fields of Court, case type and others must be selected.
- A V must be marked in the power of attorney box.
- If you wish to pay through account debit authorization and not by credit card, this must already be selected at the stage of marking the V in the power of attorney. Otherwise, it will not be possible to select this later. In order to choose this option:
- The “Representative Details” button must be clicked.
- It is necessary to move to the “Bank Account” tab and verify the account details for debit:
- The bank account details must be completed and the “Verify Data” button clicked.
- The bank account details must correspond to the account details existing in Net HaMishpat for the office.
- If the account details do not match, they must be updated in Net HaMishpat.
- Please note: If you wish to pay by credit card or if you have an exemption from payment of a fee, there is no need to click on the “Representative Details” button.
- The “Next” button must be clicked, continue the process of defining the parties in the case, and attach the documents.
Attaching documents to the application:
- It is possible to upload additional documents through a designated “Browse” button, under the heading “Attachment of Accompanying Documents.”
- After uploading the documents, the “Next” button must be clicked and the filing process and payment of the fee continued until receipt of a confirmation number (reference) for tracking.
- If payment by credit card is selected, at the end of the filing process the system will transfer to completion of payment on the Government Payments website.
- An appointment must be scheduled and the service desk of the Court Secretariat attended.
- District filing – upon filing a claim with the Magistrates’ Court, it is possible to file the application at any service desk of the Court Secretariat in the relevant district, irrespective of the Court in which the case is to be conducted.
- Payment of the application fee is to be made at the Court Secretariat upon filing.
It is possible to send the claim by registered mail to the relevant Court.
Fee:
A fee must be paid, as detailed in the fee section on this page.
In order to obtain a fee voucher – it is necessary to go to any service desk of the Court Secretariat.
The receipt must be attached to the application.
Please note: An application sent without a receipt for the exact amount will be rejected.
For filing appendices together with the application:
The claim and appendices must be attached and sent together.
It is not possible to file the claim by fax.
- After filing the claim, the Court Secretariat checks that the statement of claim complies with the provisions of the Regulations and is complete and proper. If documents or details are missing, the Court Secretariat returns the statement of claim to the filers for correction and completion of details, using the contact details specified in the statement of claim.
- The defendants will receive the statement of claim together with a summons, specifying the time for filing the statement of defense.
- Thereafter, a hearing date is to be scheduled.
It is possible to check the status of processing the application in the Net HaMishpat system. At the end of filing the application, a confirmation number (reference) will be received, through which it is possible to track the opening of the case and obtain the case number, in two ways:
- In the attorney area:
- In the “Tracking My Filings” tab, it is possible to view the most recent filings, their confirmation numbers, and their processing status.
- It is possible to check the status of processing the application after the end of the business day following filing of the application.
- On the top bar of the website, in the “Filings” tab:
- Clicking on the tab will open a window in which “Locate Filings by Reference Number” should be selected.
- The confirmation number (reference) should be entered in the designated field and the “Search” button at the bottom left of the page clicked. The status of processing of the filing will be displayed.
- The status of processing of the application must be checked; this may be done after the end of the business day following filing of the application.
- After the case is opened, the case number will appear.
- Using the case number, it is possible to review the case – by clicking on the number.
- After entering the case, the folders therein will appear on the right side.
Please note:
- Upon filing the application, the documents will be transferred for review by the Court Secretariat.
- The Court may send requests for completion of documents, which, if not submitted within the period specified in the requests, the case will be closed. Therefore, it is highly recommended to carefully check the status of processing the application.
At the end of filing, a case number will be received. It is necessary to wait for a judicial ruling in the case.
It is possible to track the application in three ways:
- In Net HaMishpat:
- The Net HaMishpat system must be accessed using the National Identification System or a smart card. On the top bar of the website, the case number must be entered, the “Search” button clicked, and then it will be possible to review it.
- If the case number was forgotten or is unknown, it is possible to click on the “Locate Cases” tab and then select “My Cases,” enter a date range, and a list of cases will be received, from which the correct case should be selected.
- After entering the case, folders will appear on the right side. The “Paper File” folder must be entered, in which all documents in the case, including rulings, will appear.
- At the Court Secretariat where the case was opened: it is possible to go to the Court Secretariat with an ID card and request information about the case.
- At the National Information and Service Center: it is possible to call the National Information and Service Center to obtain information about the processing of the case.
It is necessary to track the arrival of the mail at the Court and wait until the end of the business day following its arrival, so that the case will be opened.
Thereafter, it is possible to track processing of the application in two ways:
- ב'נט In Net HaMishpat:
- Filers who are not represented by an attorney:
- If an email address was updated in the application, update notices from the Court will be received there.
- In order to read the notices, the link therein must be clicked, which will lead to Net HaMishpat. It must be accessed using the National Identification System. An envelope icon will appear next to the ID number; clicking thereon will open messages from the Court. In this way the Court will notify when the case is opened and will send a case number.
- Another way to check whether the case was opened on the Net HaMishpat website after logging in through National Identification is by clicking on the “Locate Cases” tab and selecting “My Cases.” A date range for the search must be selected. A list will be received in which it will be possible to select the relevant case, and then click on the case number in order to review it and check whether a ruling was received in it.
- Attorney:
- An attorney may check in Net HaMishpat the status of processing the case, through the “Locate Cases” tab and selection of “My Cases”:
- The Court and opening date range should be selected.
- If the case was opened, a case number will appear, and the attorney may click on the number in order to enter the case.
- It is important to note that on the top left side of the website, the attorney’s license number, and not the ID number, must be listed, in order to view the cases in which the attorney is the representative.
- At the Court Secretariat where the case was opened: it is possible to go to the Court Secretariat with an ID card and request information about the case.
- At the National Information and Service Center:
- It is possible to call the National Information and Service Center and inquire whether the application arrived at the relevant Court.
- Please note: The National Information and Service Center is not authorized to provide the inquirer with a case number. To obtain the case number, it is necessary to go to the Court Secretariat where the case was opened with an ID card.
