Filing a Third-Party Guarantee in an Application for Interim Relief
This service allows submitting a third-party guarantee for temporary relief, in accordance with a court decision, to secure compensation for the opposing party if damage is caused.
- Interim relief is a temporary ruling issued by the Court before the conclusion of the legal proceedings, in order to preserve the existing situation or prevent damage until a final judgment is given.

- When the Court considers approving an application for interim relief, it may require the applicants to provide a third-party guarantee, the purpose of which is to ensure compensation to the other party in the proceedings – that is, the party against whom the application for interim relief was filed – if it is determined that the application caused him damage.
What is a third party
- A third party is a person who is not part of the legal proceedings – that is, neither the applicant for the interim relief nor the party against whom the application was filed – however undertakes on his own behalf to ensure that the party who may be adversely affected by the application will receive compensation, if it is determined that damage was caused.
- For example, if a person requests to impose temporary attachments on the assets of another party, the Court may require him to file a third-party guarantee. In such a case, the applicant turns to a third party – a friend, family member or another person, who agrees to undertake before the Court to compensate the party against whom the attachment was filed, if it is determined that it was not justified and caused damage.
- The service is intended for those who filed an application for interim relief and the Court required them to provide a third-party guarantee.
- Filing the guarantee allows the applicants for the interim relief to comply with the Court’s requirement or the regulations, and thus advance the application they filed.
- There is a Court ruling requiring the filing of a third-party guarantee.
- The guarantee is signed by the guarantor and authenticated by the signature of an attorney or an authorized official at the Court, confirming the identity of the guarantor and his consent to act as guarantor.
- The guarantee is to be filed within the time determined in the Court ruling.

The form may be filed in one of two ways:
From within the case – via the 'Filings' button
- Locate and enter the case.
- Click on 'Filings'.
- Select 'New Application'.
- Attach the form via 'Attach Document' and additional files via 'Attach Appendix'.
- After the file is uploaded, click 'Next' and continue the filing process until receiving a confirmation number (reference) for tracking.
From outside the case – via the 'Quick Filing' tab
- Select the Court in which the case is being conducted.
- Combine the form and all attached documents into one PDF file not exceeding 30 MB.
- It is important to indicate on the document the case number under which the form is filed.
- Enter an email address, mark V in the designated field to confirm agreement to the filing terms and click 'Confirm'.
By registered mail or fax
The form may be printed, completed and sent by registered mail or fax to the Court where the case is being conducted.
Filing in person at the Court
- Print, complete, sign and submit the form.
- The form may be filed manually during working hours with the Secretariat of the relevant Court.
- District filing – the form may be filed at any Court within the district, according to that specified in the table regardless of where the case is being conducted, for cases for which the service exists in the district.
- Online appointment scheduling – in some Courts, an appointment may be scheduled with the public reception desk of the Secretariat in order to submit the form.
- After filing, the form is forwarded for a judicial ruling.
- The status of processing of the form may be checked in the Net HaMishpat system after logging in via the National Identification System or a smart card.

At the end of filing the form, a confirmation number will be received, by means of which it is possible to track the processing in two ways:
In the personal area:
- In the 'My Filings' tab – the most recent filings, their confirmation numbers and their processing status may be viewed.
- It is necessary to check the status of processing the form.
- This may be done after the end of the business day following the day on which the form was filed.
On the top bar of the website under the 'Filings' tab:
- Clicking the tab opens a window in which 'Locate Filings by Reference Number' should be selected.
- Enter the confirmation number (reference) and click the 'Search' button. The status will be displayed.
- It is necessary to check the status of processing of the form after the end of the next business day.
It is necessary to track the arrival of the mail at the Court and wait until the end of the business day following its arrival. After that, it is possible to track the handling in Net HaMishpat as follows:
- If an email address was updated, notifications from the Court will be received there.
- To read the messages, click on the link in them, which will lead to Net HaMishpat.
- Access must be via the National Identification System.
- Next to the ID number, an envelope icon will appear; clicking it will open Court messages.
Another way to check status of processing the form on the Net HaMishpat website after logging in via national identification:
- Click 'Locate Cases' and then 'My Cases'.
- Select a date range for the search.
- A list will appear from which the relevant case may be selected, and then click the case number to view details and check whether a ruling has been issued.
- After 3 hours from sending the fax, it is possible to contact the Courts Administration information and service center and verify that the fax has been received.
- After that, the status of processing the form may be tracked via Net HaMishpat as described above in the sub-section Filing via Net HaMishpat.
- At the end of filing, a confirmation number (reference) will be received.
- The status of processing the form may be checked through the case in Net HaMishpat:
- It should be entered via the National Identification System or a smart card.
- On the top bar of the website enter the case number and click 'Search' in order to view it.
- If the case number is forgotten or not known click on the 'Locate Cases' tab and select 'My Cases', enter a date range and a list of cases will be received, from which the correct case should be selected.
- After entering the case, folders will appear on the right. Enter the 'Paper File' folder to view all documents, including rulings.
