Application for Determination of Paternity or Maternity
This service is intended for those wishing to file with the Family Court an application for an order to conduct a genetic test for family relations, and for a declaratory judgment.
The service is intended for persons seeking to prove family relations through a genetic test.
- Affidavit of the applicants signed and verified by an attorney in the wording prescribed in the Regulations:
- In applications filed by several applicants, an affidavit for each applicant must be attached.
- Signing an affidavit before an attorney involves payment.
- Verification of affidavits at the service desk of the Court Secretariat may only be performed during public reception hours.
- During the emergency period – if it is not possible to verify the affidavit, the application will be accepted by the Court Secretariat and transferred for the judge’s ruling even without an affidavit.
- Birth notice of the child – in cases in which the child was born in Israel and is not registered in the Population Registry, the birth registration form given to the parent at the hospital upon the baby’s birth must be attached, and serves as hospital birth registration in Israel.
- Verified birth certificate if the children were not born in Israel. Verification of the certificate is performed in one of the following ways:
- By means of an apostille stamp.
- If the country in which the babies were born is not a party to the Apostille Convention, by means of a chain of signatures.
- If the certificate from the foreign country is not written in English or does not include English, the following must be attached:
- Notarized Hebrew translation of the certificate.
- Copy of identification documents of the applicants and of the child regarding whom the application was filed – ID card or valid passport of the applicants, and also of additional parties to the application if possible.
- If there are additional parties to the application, their identification documents must be attached, if possible.
- The following documents must be attached according to the circumstances:
- Marriage certificate.
- Divorce or widowhood certificate.
- Death certificate.
- The service involves a fee, detailed in Section 6 of the Family Regulations.
- It is possible to pay the fee in the ways detailed in this link.
- It is possible to file an application for exemption from payment of the fee due to financial inability.
- The application must be filed in two copies.
- When filing an application for determination of maternity, the word 'paternity' must be crossed out on the form in writing and replaced with the word 'maternity'.
Local jurisdiction
- A first family matter claim between spouses, or parents and their children, is to be filed with the Court within the jurisdiction of which their joint place of residence is located.
- If they do not have a joint place of residence – their last joint place of residence in Israel, provided that one of the parties still resides at that place of residence.
- If the claim concerns minors, the Court may order transfer of the hearing in the claim and in additional cases between the same parties to a Court in another location.
- It is possible to receive technical assistance in filing the application from the Information and Service Center of the Courts Administration. Please note – this is not legal advice, but a service provided to litigants.

- Only attorneys may file the application on the Net HaMishpat website.
- Before logging in, it is recommended to prepare all the documents scanned in PDF files only. The maximum size of each file that may be attached is up to 30 MB.
- The website may only be accessed from a computer; it is not adapted for browsing from a mobile phone.
- The website must be accessed using the National Identification System button or a smart card.
- After logging in, attention must be paid to identification as an attorney – the attorney’s license number, and not your personal ID number, is to appear at the top left.
- If the ID number appears, it may be changed by clicking on the small arrow next to the number.
- If the arrow does not appear, and it is not possible to choose your attorney’s license number, apparently you are not registered as attorneys in the Net HaMishpat database. In order to register in the database, an online registration form must be completed by entering the Net HaMishpat website and clicking on the lower link in the center of the page – Addition of a New Attorney on the Net HaMishpat website.
- In order to file the application:
- The 'Open Case' button must be clicked.
- The Court, case type and other fields should be selected.
- V must be marked in the power of attorney.
- If you wish to pay through authorization for debit of an account and not by credit card, this must already be selected at the stage of marking the V in the power of attorney. Otherwise, it will not be possible to select this later. In order to choose this option:
- The 'Representative Details' button must be clicked.
- It is necessary to move to the 'Bank Account' tab and verify the account details for debit:
- The bank account details should be entered and the 'Verify Data' button clicked.
- The bank account details must correspond to the account details existing in Net HaMishpat for the office.
- If the account details do not match, they must be updated in Net HaMishpat, for an explanation of how to do so.
If you wish to pay by credit card or if you have an exemption from payment of the fee, there is no need to click on the 'Representative Details' button.
For filing appendices together with the application:
It is possible to upload additional documents through a designated 'Browse' button, under the heading 'Attachment of Accompanying Documents'.
- The documents must be in PDF format only. Each file uploaded to the system must not exceed 30 MB.
- It is possible to file the application at the public reception desk of the Secretariat of the Family Court, according to the local jurisdiction detailed in the opening paragraph of this chapter. In some Courts it is possible to schedule an appointment – for scheduling an appointment.
- District filing – it is possible to file the application at any public reception desk of the Magistrates’ Court Secretariat in the relevant district in which there is a Family Court.
It is possible to send the application by registered mail to the Family Court according to local jurisdiction, as detailed in the opening paragraph of this chapter.
Fee:
- A fee must be paid, as detailed in the fee section on this page.
- The receipt must be attached to the application.
An application sent without a receipt for the exact amount will be rejected.
For filing appendices together with the application:
The application and appendices must be attached and sent together.
It is not possible to file the application by fax.
- After filing the application, it is transferred for a judicial ruling.
- It is possible to check the status of processing the application in the Net HaMishpat system, which must be accessed through the National Identification System or using a smart card.
- The website may only be accessed from a computer; it is not adapted for browsing from a mobile phone.

At the end of filing the application, a confirmation number (reference) will be received, through which it is possible to track opening of the case and obtain the case number, in two ways:
- In the attorney area:
- In the 'Tracking My Filings' tab it is possible to view the most recent filings, their confirmation numbers and their processing status.
- The status of processing of the application must be checked.
- This may be done after the end of the business day following filing of the application.
On the top bar of the website, in the 'Filings' tab
- Clicking on the tab will open a window in which 'Locate Filings by Reference Number' should be selected.
- The confirmation number (reference) should be entered in the designated field and the 'Search' button at the bottom left of the page clicked. The status of processing of the filing will be displayed.
- The status of processing of the application must be checked; this may be done after the end of the business day following filing of the application.
- After the case is opened, the case number will appear.
- Using the case number, it is possible to review the case by clicking on the number.
- After entering the case, its folders will appear on the right side.
- Upon filing the application, the documents will be transferred for review by the Court Secretariat.
- The Court may send requests for completion of documents, which, if not submitted within the period specified in the requests, the case may be closed.
- Therefore, it is highly recommended to carefully check the status of processing the application.
- At the end of filing, a case number will be received. It is necessary to wait for a judicial ruling in the case.
- It is possible to check whether a judicial ruling was received in the case through the Net HaMishpat website, which must be accessed using the National Identification System or a smart card. On the top bar of the website, the case number should be entered, the 'Search' button clicked, and it will then be possible to review it.
- If the case number was forgotten or is unknown, it is possible to click on the 'Locate Cases' tab and then select 'My Cases', enter a date range, and a list of cases will be received, from which the correct case should be selected.
- After entering the case, folders will appear on the right side. The 'Paper File' folder should be opened, in which all documents in the case, including rulings, will appear.
- It is necessary to track the arrival of the mail at the Court and wait until the end of the business day following its arrival, in order for the case to be opened. Thereafter, it is possible to track the progress of processing the application in Net HaMishpat in the following ways:
- Filers not represented by an attorney:
- If an email address was updated in the application, update notices from the Court will be received there.
- In order to read the notices, the link therein must be clicked, which will lead to Net HaMishpat. It must be accessed using the National Identification System. An envelope icon will appear next to the ID number; clicking on it will open messages from the Court. In this way the Court will notify when the case is opened and a case number will be sent.
- Another way to check whether the case was opened on the Net HaMishpat website after logging in through National Identification is by clicking on the 'Locate Cases' tab and selecting 'My Cases'. A date range for the search should be selected. A list will be received from which it will be possible to select the relevant case, and then click on the case number in order to review it and check whether a ruling was received in it.
- Attorney:
- An attorney may check in Net HaMishpat the status of processing the case, through the 'Locate Cases' tab and selection of 'My Cases':
- The Court and the opening date range should be selected.
- If the case was opened, a case number will appear, and it will be possible to click on the number in order to enter the case.
- It is important to note that on the top left side of the website, the attorney’s license number, and not the ID number, must be listed in order to view the cases in which the attorney is the representative.
