Filing a Statement of Claim via Fast-Track Procedure in the Magistrate Court
This service enables the filing of a claim in the Magistrate Court through the Fast-Track procedure. Parties to a court case or their legal representatives may file a statement of claim via the Fast-Track procedure, provided the claim meets one of the following conditions:
- The claim amount or the financial value of the claim does not exceed 75,000 NIS.
- The subject of the claim is the eviction of tenants from a leased property.
- Class Actions
- Claims involving personal injury resulting from a road accident
- Affidavit Verifying the Facts of the Statement of Claim. Please note: access the link and select the option "For Fast-Track Procedure."
- Expert Opinion (if required)
- Any document relevant to the matter under litigation in the claim, such as contracts, receipts, correspondence, etc.
- This service is subject to the payment of court fees.
- Payment may be made via the methods detailed on the "Charges and Payment Methods" page within the Court System.
- Download the application form to your computer and complete the required fields.
- The application must include the full details of the plaintiffs and defendants, including: full name, ID number, accurate residential address, telephone number, and email address.
The application form may be submitted via one of the following two channels—please click the relevant heading for further details:
- The application may be submitted via the Net HaMishpat website by attorneys only.
- Preparation and Technical Requirements: Ensure all documents are scanned and saved in PDF format only. Each individual file must not exceed 30 MB.
- Use a desktop or laptop computer; the website is not optimized for mobile browsing.
- Access the site using the National Digital Identity button or a Smart Card.
- Upon logging in, ensure you are identified as an attorney. Your Attorney License Number should be displayed in the upper-left corner rather than your personal ID number.
- If your ID number is displayed, click the small arrow next to the number to switch profiles.
- If the arrow does not appear and you cannot select your license number, you may not be registered in the Net HaMishpat database. To register, complete the online registration form by visiting the Net HaMishpat homepage and clicking the link at the bottom center: "Add New Attorney."
Submission Steps
- Click the "Open Case" (פתיחת תיק) button.
- Select the required fields (Court, Case Type, etc.).
- Check the "Power of Attorney" (ייפוי כוח) box.
If you wish to pay via Direct Debit Authorization rather than credit card, you must select this option at the "Power of Attorney" stage. It cannot be changed later. To select this option:
- Click the "Counsel Details" (פרטי בא כוח) button.
- Navigate to the "Bank Account" tab and verify the billing details:
- Enter the bank account information and click "Verify Data" (אימות נתונים).
- The account details must match the firm’s account information currently registered in Net HaMishpat.
- If the details do not match, you must update them in the system. Click here for instructions.
If paying by credit card or if you have a fee waiver, you do not need to click the "Counsel Details" button.
Uploading Appendices
- Additional documents can be uploaded via the dedicated "Browse" (עיון) button under the heading "Attach Supporting Documents" (צירוף מסמכים נלווים).
- Documents must be in PDF format only, with a maximum size of 30 MB per file.
- Applications may be submitted at the public reception desks of the relevant Court Secretariat.
- Parties not represented by an attorney may submit the application at any of the Court Secretariats within the district where the case is being heard. Click here for an explanation regarding District-wide Filing.
- Required Number of Copies:
- Unrepresented Parties: One copy for the court, plus additional copies corresponding to the number of defendants.
- Parties Represented by an Attorney: Two copies.
You may schedule an appointment for the public reception desk at select Court or Labor Court Secretariats via the GoVisit website.
Service of Process Stage
- The term "Service of Process" (Hamtza'a KeDin) refers to the legal delivery of documents in accordance with the law, including confirmation of receipt.
- Upon the filing of the statement of claim in the Magistrate Court, a copy shall be served to the respondents as follows:
- If the applicants are represented by an attorney, the obligation to effect service of the statement of claim upon the defendants rests with them.
- If the applicants are not represented by an attorney, the Magistrate Court Secretariat will effect service of the statement of claim upon the defendants.
- Defendants must file a statement of defence within 45 days of the date the statement of claim was served upon them.
- Following the submission of the statement of defence, the court will schedule a date for a pre-trial hearing.
Case Tracking
To view details on how to track the status of your claim, click the relevant heading:
Upon completing the submission, a confirmation number (reference number) will be issued. This number allows you to track the case's progress and obtain the case number in two ways:
- Via the "Track My Submissions" Tab
- You can view recent filings, reference numbers, and their processing status.
- You may check the status of the claim after the close of the business day following the date of submission.
- Via the "Submissions" Tab in the Top Navigation Bar
- Clicking the 'Submissions' (הגשות) tab will open a window; select 'Locate Submissions by Reference' (איתור הגשות לפי אסמכתא).
- Enter the reference number in the designated field and click the 'Locate' (איתור) button at the bottom left of the page. The processing status will then be displayed.
- The status and case number will be available following the close of the business day after the form was submitted.
- Once the case number appears, you may review the file by clicking on the number.
- After entering the case, the relevant folders will be displayed on the right-hand side.
- Upon completion of the submission, a case opening confirmation will be issued.
- You may check for any notices or decisions issued in the case via the Net HaMishpat website, which requires authentication through the National Digital Identity system or a Smart Card.
- Enter the case number in the search bar located in the top navigation bar and click the "Locate" (אתר) button to review the file.
- If the Case Number is Unknown:
- Click the "Locate Cases" (איתור תיקים) tab and select "My Cases" (התיקים שלי). Enter a date range to generate a list of cases, from which you can select the correct one.
- After entering the case file, the relevant folders will appear on the right-hand side. Select the "Paper File" (תיק נייר) folder to view all case documents, including court decisions.
