Application for the Appointment of a Guardian for the Person – Urgent Medical Intervention

An application for the appointment of a guardian must be submitted to the Family Court where a person is unable to make decisions regarding their medical matters and requires urgent medical intervention.

The application must be supported by a medical certificate confirming the need for urgent medical treatment. The certificate, prepared by a physician, should include, among other things, an explanation of the nature of the required treatment, the risks and prospects of performing or not performing the treatment, the degree of urgency, a recommendation regarding the need to appoint a guardian, and the required duration of the appointment.

Required Documents

• The application form and the attached affidavit must be completed.
• The affidavit must be verified before a lawyer or an authorized court official.
• Medical certificates attesting to the mental and/or medical condition of the person for whom a guardian is sought must be attached.
• It is recommended to attach consent forms signed by close family members, verified before a social worker or the Court Registry.
• A social report must be attached.
• The application must be submitted in two copies.
