Registration on the Responsible Representatives Registry

Who can register on the registry

• Manufacturers and importers planning to market a cosmetic product in Israel must appoint a responsible representative with appropriate knowledge and training
•  All responsible representatives may register on the Responsible Representatives Database through the portal, in accordance with the Pharmacist Ordinance [New Version], (1981) and the Pharmacists Regulations (Cosmetic Products), 2023
• A responsible representative will be one of the following:
  • The manufacturer’s general manager
  • The general manager of the cosmetic product’s importer
  • Anyone who has been appointed by the manufacturer's or importer's general manager to be a responsible representative and has given their consent 

Who does not have to register on the registry

• Manufacturers who manufacture or distribute a cosmetic product only for export outside of Israel
• Manufacturers or importers who manufacture or import a cosmetic product in accordance with the Order for Supervision (cosmetic products obtaining a designated cosmetic product license from the Ministry of Health)
   

What are the conditions for registration on the Responsible Representatives Registry

Registration is only possible for people fulfilling the following conditions (in the case of a corporation’s contact person):

• Israeli citizens
• A corporation registered and operating in Israel, including a corporation registered as a foreign company in accordance with the Companies Law, 1999
• Anyone who is not a minor (above the age of 18)
• Anyone who is legally incompetent

Who cannot register on the Responsible Representatives Registry

• People determined as unfit to serve as responsible representatives (Section 55 9a(b) under the Pharmacists Ordinance)
• People whose registration as  responsible representatives has been revoked in the past and the annulment period has not yet expired
• People holding a position in a corporation who have been convicted or charged with a crime listed below and the case is still ongoing are not fit to register as responsible representatives because of the severity or circumstances of the offense

The database of the responsible representatives will be open for review and will include the following details:

• Name of the responsible representative
• Responsible representative’s contact details 
• Name of the cosmetic products for which the responsible representative is accountable 

List of offenses:

• Section 7(4) of the Pharmacists Regulations (Cosmetic Products), 2023, determines that a responsible representative or a person holding a position in a corporation who has not been convicted or charged with a crime and the case is still ongoing is not fit to register as a responsible representative in the manager’s opinion due to the nature, severity, or circumstances of the offense
• Offenses such as:
  • An offense under Section   (338)(a)(8) and (9) of the Penal Code, 1977 (hereinafter: Penal Code) (actions of negligence and recklessness)
  • An offense under Section 497 of the Penal Code (preparation of an offense involving hazardous materials)
  • An offense under Section 60(a)(6b) to (7) of the Pharmacists Ordinance
  • An offense under Section 60(b)(26a) to (29) of the Pharmacists Ordinance
