Notice of Postponement of Sale Date – Project TAMA 38 (Form 7738)
This service allows the submission of a notice of sale of real estate rights or sale of real estate options, as part of project TAMA 38.
Who may submit the application
A seller and buyer of a right in real estate or an option to sell a right in real estate, as part of TAMA 38 project, requesting to postpone the sale date in accordance with the provisions of Section 49(u)1 of the Real Estate Taxation Law.
What must be attached
- Land registry extract.
- Condominium registration order.
- Written engineer's certificate submitted to the local committee engineer stating that he examined the structure's resistance to earthquakes and determined that there is a need and possibility to strengthen the structure (Sections 8-9 of TAMA).
- Appraisal reports from the local committee on behalf of the rights holders as well as a decisive appraiser's assessment to determine the amount of the betterment levy.
- Application for a building permit that includes a breakdown of building areas under TAMA 38 and other projects.
- Details of the fees for granting a building permit that were paid according to the details of the areas under TAMA 38 and additional areas under other projects.
The service is provided free of charge.
How to submit the application
The notice of postponement of the sale date will be submitted on a designated form, Form 7738, to the regional office by mail, at the document submission desk.
- All details appearing on the form must be filled out, and the required documents must be attached.
- The notice will be signed by the seller and buyer of the real estate right, and will be verified by an attorney after identifying the signatories and warning them.
Further processing of the application
Upon receipt of the application by the regional office, its completeness will be examined and the application will be forwarded to the processing entity.
