Petition for a Probate Order
A petition for a probate order to the Registrar for Matters of Succession (hereinafter: "The Registrar") is filed to put the Decedent's Will into effect. The petition may be submitted by one of the beneficiaries specified in the Will.
In general the petitioner must be one of the beneficiaries under the Will.
If the petitioner is represented by an attorney, the petition MUST BE filed digitally.
- The original Will .
- When the Decedent has an Israeli ID number, it is not necessary to attach a death certificate. If the Decedent died outside of Israel, and has an Israeli ID number, it is necessary to update the fact of the death in the Population Registry of the State of Israel, prior to submitting the application. If the Decedent does not have an Israeli ID number, it is necessary to produce a duly verified death certificate. If it is not possible to produce a death certificate, then it is necessary to submit an application to prove the death in another manner. You may file an application on our website to prove a will when the original is
unavailable. - If any of the beneficiaries died, whether before or after the Decedent, you must submit a death certificate for each such beneficiary.
- You must attach a copy of the notice sent to each beneficiary regarding his entitlement under the Will and confirmation that such notice was sent by registered mail. Alternatively, you may submit an Confirmation of the petitioner that he personally informed all the beneficiaries of their entitlement under the Will.
- Powers of attorney, if the petitioner is represented .
- Confirmation of payment of the fee and publication charges.
- If any of beneficiaries wishes to renounce his share in the estate, you must submit “Declaration of Renunciation,” signed by the beneficiary and duly verified by an attorney.
If beneficiaries under the Will do not include at least one of these relatives of the Deceased: Spouse; children and their progeny; parents; siblings and their progeny)
then you must submit an affidavit listing all the Decedent's legal heirs and a copy of notice of filing the petition, sent to each such heir by registered mail.
VAT is not added to payments that are payable to the State and, therefore, the State is not required to issue a tax invoice in respect of such payments.
It is possible to claim recognition of these expenses, as the case may be, and in accordance with the Income Tax Ordinance.
In order to submit an application for a Succession Order or a Probate Order you must pay two fees: an application fee and a publication fee. If the application is submitted online you will pay a reduced application fee.

Payment can be made online through the Government Payment Service.

Automatic Payment Stations
Payment can be made by credit card at the automatic payment stations located in the district offices of the Registrar.
You must file the petition in the District closest to the Testator’s last residence. In order to locate the relevant District :
If the petitioner is represented by an attorney – the petition may be filed online only.
- Upon the sending of the online form, the petitioner will receive an email message confirming the receipt of the form. (this message does not constitute confirmation that the application has been properly submitted).
Petitioners must submit the original Will to the Registrar offices within seven days submitting the petition. The original Will may be submitted by registered may or by personal delivery to the Registrar, on Mondays and Wednesdays, between the hours of 08:30 a.m. and 12:30 p.m., by making an appointment in advance only.
You may also submit the will in the service boxes, from Sundays through Thursdays, between the hours of 08:30 and 16:00. - The petition will be checked and if all the information is filled in and all the required documents attached, an additional email message will be sent, informing the petitioner that the petition has been received. Only this notice constitutes confirmation that the online petition was properly received by the Registrar's office.
If the petitioner is not represented by an attorney
It is possible to choose one of the following methods:
Submission of the Application Online – same as above.
Manual petition
- You must download the petition for a Probate Order Form, and fill in all of its sections.
- Submit the petition together with all the documents that are required, at the Offices of the Registrar.
You may submit the petition in the service boxes, from Sundays through Thursdays, between the hours of 08:30 and 16:00.
In order to receive the stamp, “RECEIVED,” the petition with the original Will may be submitted at the District Offices, on Mondays and Wednesdays, between the hours of 08:30 and 12:30., by making an appointment in advance only. - You can also send all the documents required by registered mail to the Registrar's offices.
- The petition will be published in the Official Gazette and in a daily newspaper.
- Concurrently, the petition is referred to the Registrar’s Assistant or to the Counsel for the Attorney General at the Administrator General. If necessary, the petitioner will be requested to provide clarifications and/or further details.
- After the above process is completed, the file will be referred to the Registrar to issue a Probate Order. If the Registrar is not authorized to issue a Probate Order, as set forth in Section 67A of the Succession Law, 5725-1965, the petition will be transferred to the Family Court.
The Probate Order granted by the Registrar will be sent to the email address of the petitioner or to his representative. Simultaneously, the Probate Order is also appeared to government ministries, banks and insurance companies.
The following entities and the government ministries work in cooperation with the Registrar for Matters of Succession: The Land Registration and Settlement of Rights Department (the Land Registry Office), the Israel Lands Authority, the Ministry of Transport, the Ministry of Foreign Affairs, the Israel Tax Authority, the Israel Corporations Authority, banks and insurance companies. - Generally, a Probate Order will be issued within 40 days of supplying the original Will.
Should the petition be referred to the Counsel for the Attorney General, his initial response will be given within 30 days , and in such an event, generally, the Probate Order will be issued within 50 days. - Should the petitioner be requested to provide clarifications and/or further details, the documents must be submitted through the Registrar Online System – Performing Actions and Completing Documents.
Any delay in the supply clarifications and/or further details will delay issuing the Probate order.
To receive a copy of an order that has been issued by the Registrar for Matters of Succession, go to the website of the Registrar for Matters of Succession Online, and submit an application for a copy of an order and pay the appropriate fee.
The Registrar for Matters of Succession does not issue printed orders and it is not possible to receive copies of orders from the offices of the Registrar for Matters of Succession.

In the event that the Will does not refer to the entirety of the deceased's property, you may submit a petition for the grant of a succession order with regards to the remainder of the estate.
If petitioner does not possess the original Will , he must file an additional petition to probate a copy of the Will.
