Request for a permit for unpaid leave according to the Women's Employment Law, due to the security situation.
This service allows employers who wish to grant unpaid leave to an employee protected under the Women's Employment Law due to the security situation, to submit a request to the Ministry of Labor online.
The Women's Employment Law protects the jobs of employees in the following situations:
- Pregnant employee.
- Employee undergoing fertility treatments.
- Employee during maternity and parental leave.
- 60 days after the end of maternity and parental leave.
- Employee in a shelter for abused women.
- Employee working in surrogacy.
Employers who wish to obtain a permit to reduce working hours and salary (unpaid leave) according to the Women's Employment Law, due to the security situation, can submit a request to our office.
What are the conditions for granting unpaid leave to an employee protected under the Women's Employment Law
Unpaid leave is initiated by the employers for a period of no less than 14 days, provided that the following conditions are met:
- Unpaid leave (referred to as "Chalt") is not related to the reason the employee is protected – this is a prerequisite.
- The employee cannot come to work or perform their duties due to the security situation.
- The employers made an effort and could not find suitable alternative work for the employee.
- The employers decided to place the employee on unpaid leave after their business activity was restricted or reduced due to the security situation.
The position the employee held was part of the activity that was restricted or reduced as mentioned above, and the employers placed additional employees on unpaid leave for the same reason.
- It should be emphasized that if the employer receives a permit to place employees on unpaid leave and the security situation returns to normal before the permit expires, the employee must be reinstated to work with the same scope of position and salary.
- If there is no change in the security situation and the employee is protected under the Women's Employment Law and cannot continue to be employed at the same scope of position and salary, the employer must contact our office to extend the validity of the permit.
How to submit the request:
- The application must be submitted using the online application form only.
- The online form must be filled out in its entirety.
Further processing of the application.
- After filling out and submitting the online form, the request will be reviewed by the ministry.
- The request will be processed after all required data is provided and after a copy of the permit request is sent to the employee for whom the permit is requested.
- The decision will be sent to the employers and the employees.
