Request for additional construction in residential areas
This service allows property owners to submit a request for an additional construction in residential areas.
Who can submit request
Owners of rights to the property.
What are the conditions for the request submission
- Existence of capitalized lease agreement.
- Signature of the landowners:
- The local planning and building committee is the body authorized to issue building permits.
- The Planning and Building Law conditions the granting of the permit upon fulfillment of several requirements and conditions.
- One of the law conditions for granting the permit is the signature of the landowners.
- Prior approval by Israel Land Authority:
- Additional construction requested by the rights holders under a development agreement or lease agreement or sales agreement, which has not yet been registered with Land Registry Office, requires prior approval by Israel Land Authority.
- The conditions for this are that the plan applicable to the allocated land allows its implementation, and the rights holders comply with the terms of the agreement signed with the Authority.

What should be attached to the request
All mandatory documents listed in the request form should be attached.
Cost of the service
- Israel Land Authority will charge permit fees for granting its consent to the rights holders to derive additional benefit from the land beyond that which they acquired within the boundaries of the original allocation area.
- The permit fees will be determined in accordance with the rules used by the Authority. The Authority may establish tables and price lists for land values. The management of Israel Land Authority is authorized to establish rules for the use of tables and price lists for land values for all types of land uses and designations.
- Permit requests or properties exempt from payment of permit fees:
- Property for which a sales agreement has been signed.
- Property to which the right of ownership has been acquired or there is a right to grant the right of ownership without payment in accordance with the provisions regarding the granting of ownership.
- Recipients of Medal of Valor – for additional construction in residential areas only.
- Holders of capitalized lease agreement, which includes future rights.
- Requests within the framework of abbreviated licensing procedure specified in the file of Council's decisions in section 5.5.49 of the First Appendix. Permit requests for an area exceeding that specified in this section should be subject to the payment of permit fees.
- If the original lease agreement stipulates that no permit fees will be charged, Israel Land Authority may condition its consent on the implementation of the remaining provisions of the agreement, including provisions regarding the update of the annual lease fees.
- Tenants who seek to exhaust their rights under the individual contract should not be entitled to the benefits provided in the decisions of Israel Land Council, which were determined after the lease commencement date.
- At the time of calculating the permit fees, calculation of the acquisition of ownership should also be carried out in accordance with subsection 5.1 of the Israel Land Council's decisions on the transfer of ownership in Israeli lands and in accordance with the procedure of ownership acquisition. Both alternatives should be directed to customers. Acquisition of ownership or upgrading of lease right without payment or for a payment that has been paid provides exemption from the payment of permit fees.
How to submit request
- Print out and fill in the request for additional construction in residential areas (in lease agreement and development agreement - low-rise construction only).
- Attach all required documents.
- Send by registered mail to Israel Land Authority to the region where the land is located for which the request is submitted.
It is possible to find out the address of the business region that handles the requested property in one of the following ways:
- Through the personal area of Israel Land Authority (My ILA).
- Through the "Who Serves You" service.
- At the phone call center: *5575 or 03-9533333.
Continuation of the request handling
- If the documents have been submitted and filled out correctly - the request will be forwarded to the costs committee for review and further processing by the professional units at Israel Land Authority.
- Notification to this effect, along with the case number and a voucher for the fee payment, will be sent to the applicants.
- If corrections are required - the application will be returned to the applicants, with all the mandatory documents that were submitted, for their correction and resubmission.
- If request is rejected - a written notification will be sent.
